MIRVAC DIMENSIONS LOYALTY PROGRAM TERMS AND CONDITIONS

1. Introduction

These Terms and Conditions set out the basis on which we offer Mirvac Residential’s Dimensions Loyalty Program. Every Member is bound by these Terms and Conditions.

The Terms and Conditions are effective as at the date specified at the end of these Terms and Conditions and may be amended by Mirvac Group from time to time in accordance with clause 13.3.

Under the Dimensions Loyalty Program, Members may be eligible for various Benefits including:

  1. Priority Notification and Access to purchase residential product being sold by Mirvac (described in clause 6);
  2. Repeat Purchase Rewards relating to the purchase of residential product from Mirvac (described in clause 4);
  3. Family Share offer (described in clause 5); and
  4. Mirvac Benefits Membership which gives access to third party offers, products, services or other benefits (described in clause 7.1 and 7.2);

Capitalised terms used in these Terms and Conditions have the meaning set out in clause 13.11

2. MEMBERSHIP ELIGIBILITY

2.1 ELIGIBILITY TO APPLY FOR MEMBERSHIP

You are eligible for Membership if you are a natural person 18 years of age or over and have either:

  1. (a) entered into an Eligible Contract; or
  2. (b) been nominated by a company, superfund or trust that has entered into an Eligible Contract (Entity Purchaser), provided that an Entity Purchaser must not nominate more than two persons to be eligible for Membership per Eligible Contract.

2.2 WHAT IS AN ELIGIBLE CONTRACT?

An Eligible Contract is a contract for sale:

  1. (a) between you and Mirvac entered into after the commencement of the Dimensions Loyalty Program;
  2. (b) for the purchase by you of residential property within a Participating Development but excluding any contract for sale entered into:
    1. (i) for the separate purchase of car spaces, storage or units;
    2. (ii) as a result of a tender;
    3. (iii) by a Builder;
    4. (iv) in commercial quantities by a purchaser (as determined by Mirvac);
    5. (v) by institutional buyers (as determined by Mirvac); or
    6. (vi) that has been the subject of a nomination or assignment.
In addition Mirvac may, in its absolute discretion, determine one or more contracts for sale entered into prior to the commencement of the Dimensions Loyalty Program to be an Eligible Contract.

A Participating Development means a residential development within Australia by Mirvac that we tell you from time to time is part of Dimensions Loyalty Program and offers a particular Benefit. Not all developments Mirvac are involved in are included in the Mirvac Dimensions Loyalty program. Those developments not participating may include, but are not limited to, developments undertaken under by Mirvac under a joint venture, fund or fee for service structure.

Some Participating Developments also do not offer all the Benefits (eg, they may offer Priority Notification and Access and not Repeat Purchaser Rewards or Family Share Offer).

2.3 BECOMING A MEMBER

  1. (a) If you are or will become eligible for Membership under clauses 2.1 and 2.2, then in order to become a Member you must:
    1. (i) indicate your acceptance of the membership offer made to you by Mirvac’s sales consultant when you enter into your Eligible Contract;
    2. (ii) accept the membership offer made by Mirvac in any form prescribed by Mirvac in the offer; or
  2. (b) You acknowledge and agree that some Benefits only become available once you satisfy the Purchaser Conditions in the Eligible Contract.
  3. (c) Membership is offered free of charge, but can be revoked by Mirvac at anytime (by notice in writing to you) for your failure to comply with these terms or any terms in an Eligible Contract.

3. Membership tiers

3.1 Members may be entitled to receive Benefits depending on their Membership Tier as described in this clause 3 (Membership Tier).

3.2 Your Membership Tier is determined by Mirvac based on your satisfaction of the relevant conditions set out in the table below. The table also set out the Benefits associated with each Membership Tier (other than the Repeat Purchase Reward, which is set out in clause 4.2):

3.3 Mirvac may (by notice in writing to you) vary the conditions for Membership Tiers, including the minimum number of Eligible Contracts provided that any Membership Tier attained prior to the date of variation is honoured (i.e. elevation to higher Tiers will require compliance with the new conditions from the date of variation).

3.4 Where there are multiple purchasers of a Mirvac Property, each of the purchasers may be individually entitled to Membership subject to clause 2.1 and 2.2.

3.5 Not all Participating Developments will offer all Benefits, Members should refer to the individual details provided for each Participating Development for details.

3.6 For the purpose of determining the Tier status of Member, where there are multiple purchasers each Member purchaser will be entitled to count the Eligible Contract as a purchase.

4. Repeat Purchase Reward

4.1 Overview

On and from the commencement of the Dimensions Loyalty Reward Program, Members are entitled to receive a Repeat Purchase Reward for their second (and then any subsequent) Eligible Contracts which result from a Direct Sale.

The Repeat Purchaser Reward is:

(a) For built form sales, a dollar value credit to be applied toward optional upgrades subject to those upgrades still being available for the relevant Participating Development. Where no optional upgrades are available, no Repeat Purchase Reward will be provided; or

(b) For land-only sales, a gift card reward for the relevant Participating Development in accordance with clause 4.5 and as set out in the relevant Eligible Contract (Repeat Purchase Reward).

4.2 Value of Repeat Purchase Reward

Land-only sales

The Repeat Purchase Reward for Land-Only Sales will be $1,000 as gift card per sale regardless of Tier, redeemable in accordance with clause 4.5.

The gift card provided as the Repeat Purchase Reward may be subject to terms and conditions of the gift card issuer. Any dispute pertaining the gift card is strictly between the Member and the gift card issuer.

Any queries regarding the activation, use, operation or any other query in relation to the gift card must be referred to the card issuer. Details of the card issuer can be provided upon request of a Mirvac Sales Consultant.  Gifts cards must be activated and redeemed within the timeframes identified on the gift card or as otherwise provided by the terms and conditions of the card issuer.

Built Form Sales

The Repeat Purchase Reward will be available as set out below:

*Where the Built Form Sale is a Mirvac House and Land Package, the value of the Repeat Purchase Reward is calculated on the Lot Price of the contract for the sale of the land and is not calculated on or inclusive of the contract sum under the building contract.

4.3 No Cap

There is no cap on the total aggregate value of Repeat Purchase Rewards that a Member may be provided.

4.4 Multiple purchasers - Repeat Purchase Reward

Where there are multiple purchasers under an Eligible Contract and more than one of those purchasers is a Member, the Repeat Purchase Reward for that Eligible Contract will be an amount calculated by reference to the purchaser with the highest Membership Tier. 

4.5 Redemption of Repeat Purchase Reward and No Credit for Unused Value

  1. (a) The Repeat Purchase Reward is redeemable for select optional upgrades or gift card reward available for the Participating Development to be provided by (and subject to) settlement of the Eligible Contract. Any Repeat Purchase Reward provided as a gift card reward (as determined by Mirvac pursuant to clause 4.1) will be provided by way of a gift card and subject to settlement of the Eligible Contract.
  2. (b) The Repeat Purchase Rewards are not transferrable to another property or for cash. To the extent the Repeat Purchase Reward value is not being provided as a gift card reward and is not or cannot be fully taken up in optional upgrade value it will be automatically forfeited and, cannot be claimed as (and does not constitute) a discount or rebate on, or reduction of, the Lot Price under the Eligible Contract or any other contract with Mirvac.
  3. (c) The process for redemption of the Repeat Purchase Reward via selection of optional upgrades will be set out in the Eligible Contract and any component of the Repeat Purchase Reward not redeemed in accordance with that process will be forfeited.
  4. (d) The Repeat Purchase Reward cannot be redeemed in addition to other promotional offers.

4.6 Stamp Duty

The value of the Repeat Purchaser Reward may be included in the dutiable value under the Eligible Contract, and Members should obtain their own tax and legal advice on their duty liability. Mirvac is not liable for any duty payable on an Eligible Contract including any duty payable in respect of the value of a Repeat Purchase Reward.

5. Family Share Offer

5.1 Overview of Family Share Offer

  1. (a) Members are encouraged to introduce Family for the referred family member to potentially receive Repeat Purchase Rewards (Family Share Offer) in Participating Developments that offer the "Family Share Offer":

  2. (b) In accordance with the Table at clause 3.2, where Family is referred to Mirvac by:

    1. (i) a Bronze Member, the Referred Family Purchaser will not be eligible for a Repeat Purchase Reward;
    2. (ii) a Silver Member or above, the Referred Family Purchaser will receive a Repeat Purchase Reward equal to 0.5% of the Lot Price on their first Direct Sale Contract for a Built Form Sale or a $1,000 gift card for a Land-Only Sale to kick start their property journey as set out in clause 3.2.                                          

5.2 Eligibility for Family Share Offer

To be eligible for the Family Share Offer, the following conditions must be satisfied:

  1. (a) the Family Referrer must be a Silver Member or above and:

    1. (i) have satisfied all Purchaser Conditions under their existing Eligible Contract(s);
    2. (ii) complete the downloadable form (and confirm that the proposed Referred Family Purchaser satisfies the definition of Family as it relates to the Family Referrer) on or before the Referred Family Purchaser enters into their Eligible Contract;
  2. (b) the Referred Family Purchaser must:

    1. (i) satisfy the definition of Family as it relates to the Family Referrer;
    2. (ii) not be an existing Member;
    3. (iii) on or before entering into their first Eligible Contract, nominate and warrant to Mirvac that the Family Referrer was their referrer and that the Family Referrer satisfies the definition of Family as it relates to them,

    (Referred Family Purchaser) ; and
  3. (c) the Referred Family Purchaser must enter into, and satisfy any Purchaser Conditions in an Eligible Contract;
  4. (d) the Eligible Contract entered into by the Referred Family Purchaser must be a Direct Sale Contract in a Participating Development that offer the Family Share Offer; and
  5. (e) if requested by Mirvac, the Family Referrer and the Referred Family Purchaser must provide a signed statutory declaration (in the form required) and cite to Mirvac or its representative original or certified supporting documentation confirming that the Family Referrer and the Referred Family Purchaser meet the definition of Family.

5.3 Family Referrer

A Family Referrer can make any number of referrals to members of their Family. A Family Referrer does not receive any Benefits for being a Family Referrer in addition to their Membership Benefits under this loyalty program.

5.4 Stamp Duty

The value of their Repeat Purchase Reward may be included in the dutiable value under the Eligible Contract, and Referred Family Purchasers should obtain their own tax and legal advice on their duty liability. Mirvac is not liable for any duty payable on an Eligible Contract including any duty payable in respect of the value of a Repeat Purchase Reward or Family Share Offer.

6. Potential Priority Notification and Access

6.1 Rights of Members and Referred Family Purchasers

After becoming a Member, you may receive:

  1. (a) notification of upcoming Participating Developments releases prior to the general public in accordance with clause 6.2; and
  2. (b) access to purchase properties in Participating Developments, before they are notified, or released for sale, to the general public (unless the Member or Referred Family Purchaser has unsubscribed from receiving these notifications or access).

6.2 Order of Priority Notification and Access

  1. (a) Mirvac reserves the right to notify all Members generally at the same time of an upcoming Participating Development regardless of membership Tier, or to notify them in order of Tier level starting with the highest memberhsip tier and working downwards.
  2. (b) In a Participating Development stage release Members may be prioritised in the queue to purchase based on their Tier level as well as the time and date they register.
  3. (c) Members acknowledge that Mirvac officers, employees, partners as well as clients wishing to amalgamate apartments may receive Priority Notification and Access prior to Members.

7. Mirvac Benefits

7.1 Eligibility

  1. (a) Members are eligible for Mirvac Benefits from time to time as part of their Membership.
  2. (b) Mirvac Benefits includes but are not limited to:

    1. (i) Invitations to VIP events
    2. (ii) Gifting on Purchase & Settlement
    3. (iii) VIP Partner Benefits
    4. (iv) Exclusive invitations to launches, presales and previews to preferred property
    5. (MM Benefits)
  3. (c) MM Benefits may only be redeemed in accordance with the relevant MM Benefits terms and conditions.

7.2 Terms of Conditions of MM Benefits including VIP Partner Benefits

  1. (a) The MM Benefits offered by Mirvac or VIP Partners and their terms and conditions may vary from time to time. Details of these MM Benefits may be notified by email, mail or SMS (unless the Member has unsubscribed from receiving these notifications) or notified on the Dimensions website.
  2. (b) In relation to MM Benefits, you acknowledge and agree that:

    1. (i) any goods or services provided by VIP Partners are supplied by third parties. There is no contract between you and any Mirvac entity in relation to those goods or services;
    2. (ii) VIP Partners may offer goods or services subject to terms and conditions, including regarding when MM Benefits are available or may be redeemed, and it is your responsibility to inform yourself of those terms and conditions; and
    3. (iii) MM Benefits can not be converted to or exchanged for money;

8. Transfer of membership

Membership (along with any Member Benefits) is personal to the Member and must not be transferred or assigned without Mirvac’s written consent, which may be given or withheld in its discretion. A Member must not request, receive or accept any consideration (in the form of payment or otherwise) for any transfer or assignment in accordance with this clause.

9. Contracts that do not complete

If an Eligible Contract is:

  1. (a) novated (or an alternative purchaser nominated);
  2. (b) brought to an end before settlement for any reason other than vendor default; or
  3. (c) the subject of a breach or default by the Purchaser,
the contract will no longer be an Eligible Contract and no Member can rely on it for the purpose of receiving any Benefits or Tier rating under Dimensions Loyalty Program.

10. Termination of program membership

10.1 You may cancel your Membership at any time and for any reason by emailing dimensionsloyalty@mirvac.com

10.2 Membership will automatically terminate on the death of a Member unless a Membership transfer is approved by Mirvac.

10.3 Benefits earned or accumulated but not yet redeemed or transferred prior to the death of the Member will be honoured on settlement of the Eligible Contract by the estate. In the event the Eligible Contract does not settle, any Benefits will be automatically forfeited.

11. Member obligations

Members must not:

  1. (a) act in any way that breaches these Terms and Conditions;
  2. (b) abuse or misuse the Dimensions Loyalty Program;
  3. (c) supply or attempt to supply false or misleading information or make a false representation to Mirvac;
  4. (d) sell, assign or transfer, or offer to sell, assign, or transfer, the Member’s Membership or any Benefit. Any Benefit under Dimensions is personal to that Member; or
  5. (e) seek to obtain any commercial benefit from the Dimensions Loyalty Program.

12. Privacy

12.1 Mirvac agrees to use any Personal Information collected in accordance with Mirvac’s Privacy Policy available here.

12.2 The types of Personal Information Mirvac may collect and hold includes name, address, date of birth, age, language preferences and nationality, contact details like phone numbers and email addresses, as well as electronic information from your use of our website.

12.3 A Member agrees to provide Mirvac with Personal Information in order to participate in Dimensions Loyalty Program, and to keep that information up to date.

12.4 If a Member does not provide or update the Personal Information required by Mirvac, the Member acknowledges that it may not be entitled to receive certain Benefits.

12.5 Mirvac may send electronic communications to the Member regarding third party offers, products and services available as part of Dimensions Loyalty Program and by joining Members consent to this but can unsubscribe from such electronic communications by using the unsubscribe function in these communications.

13. General Conditions

13.1 Commencement

The Dimensions Loyalty Program commenced on 1 July 2025 and all Eligible Contracts entered into on or after that date may entitle a purchaser under the Eligible Contract who is a Member to obtain Benefits.

13.2 Membership

Mirvac reserves the right to reverse a Benefit or exclude, withdraw or terminate a Membership in the event of:

  1. (a) the breach of any of these terms and conditions by the Member; or
  2. (b) breach or termination of an Eligible Contract of a Member.

13.3 Variations

  1. (a) Mirvac reserves the right (acting reasonably) to, at any time by notice in writing to Members:

    1. (i) cancel, substitute or vary any of the Terms and Conditions of Dimensions Loyalty Program (in whole or in part); or
    2. (ii) exclude, substitute, vary or withdraw any Participating Developments and the Benefits it offers (in whole or in part).
  2. (b) Mirvac will give Members notice of any cancellation, substitution or variation to Dimensions Loyalty Program under this condition by either email, mail or SMS and provide notice on the Dimensions website.
  3. (c) Mirvac may in its discretion maintain additional or separate loyalty programs and/or Membership Tiers to those set out in these Terms and Conditions. 

13.4 Liability

To the maximum extent permitted by law, Mirvac is not liable for any cost, loss or damage incurred by a Member in connection with:

  1. (a) any withdrawal, cancellation, variation or change to these Terms and Conditions;
  2. (b) any breach of these Terms and Conditions by any person other than Mirvac;
  3. (c) providing any Benefit; or
  4. (d) any tax or accounting implications of any Benefit.

13.5 GST and Tax

The amount of any Benefit specified in these Terms and Conditions (including if specified by way of a percentage of another amount or otherwise) includes the amount of any GST or similar value added tax (if any) payable or arising on or in relation to the benefit. If providing any Benefit is the consideration for a taxable supply for GST purposes, the relevant Member must deliver a tax invoice or an adjustment note to the Mirvac entity who is the recipient of the taxable supply before the Member is entitled to payment of any amount in relation to any Benefit.

Any tax, liability or duty in relation to any Benefit provided to a Member will be the sole responsibility of the Member. Members should contact their accountant or taxation advisor if they have any queries relating to the tax implications of Dimension.

13.6 Governing law

These Terms and Conditions are governed by New South Wales law. Any person relying on, or seeking to enforce, these Terms and Conditions submits to the non-exclusive jurisdiction of the courts of New South Wales and any courts competent to hear appeals from those courts.

13.7 Severability

If any provision of these Terms and Conditions is unenforceable or invalid, it must be read down so as to be enforceable and valid. If this is not possible, the provision may be severed without affecting the enforceability or validity of the remaining provisions.

13.8 Waiver

Any failure or delay by Mirvac in exercising its rights under these Terms and Conditions does not constitute a waiver. Any waiver by Mirvac must be in writing.

13.9 Interpretation

Unless otherwise stated:

  1. (a) a singular word includes the plural, and a plural word includes the singular;
  2. (b) if a word or phrase is defined, any other grammatical form of that word or phrase has a corresponding meaning;
  3. (c) if an example is given of anything (including a right, obligation or concept), such as by saying it includes something else, the example does not limit the scope of that thing;
  4. (d) all amounts stated in this document are in Australian dollars; and
  5. (e) a reference to a clause or paragraph is to the clause of, or the paragraph within that clause of, these Terms and Conditions; and
  6. (f) a reference to a statute or other law includes regulations and other statutory instruments under it and consolidations, amendment, re-enactments or replacements of any of them.

13.10 Dispute Resolution

  1. (a) If a person (including any Member or another person who is not a Member) has any dispute, claim, question or disagreement arising from or relating to the Dimensions Loyalty Program or these terms and conditions (Dispute) then the person must first raise the Dispute with their Mirvac sales consultant, or if they do not have a Mirvac sales consultant, provide details of the Dispute to dimensionsloyalty@mirvac.com.
  2. (b) Mirvac and the person must attempt to resolve the Dispute in good faith within 60 days of the person raising the Dispute pursuant to clause 13.10(a).
  3. (c) Neither the person raising the Dispute nor Mirvac is permitted to commence any legal proceedings in relation to the Dispute until they have attempted to settle the Dispute in accordance with this clause 13.10, except where a party seeks urgent interlocutory relief from a court of competent jurisdiction to preserve their rights pending resolution of the Dispute

13.11 Definitions

In these Terms and Conditions, capitalised terms have the following meanings:

Benefit means any benefit, privilege, promotion or reward offered under Dimensions Loyalty Program (including the Benefits listed in clause 1). Bronze means the Bronze Membership Tier as described in clause 3 and Bronze Member has a corresponding meaning.

Builder means a residential home builder or Related Entity of a residential home builder who enters into a contract to acquire an interest in one or more residential lots in any Participating Development on account of them or a Related Entity intending to build a display home or a home for someone else on the property.

Built Form Sale means the Eligible Contract is for the sale and purchase of:

 

(a) a residential apartment

(b) a terrace house or townhouse; or

(c) a Mirvac House and Land Package

in a Participating Development.

Dimensions Loyalty Program means the loyalty program described in these terms and conditions.

Direct Sale means the sale occurred without the involvement of an external vendor’s real estate agent (other than Mirvac Real Estate Pty Ltd)

Direct Sale Contract means an Eligible Contract that is entered into as a result of a Direct Sale.

Dispute has the meaning given in clause 13.10(b).

Eligible Contract has the meaning given in clause 2.2.

Entity Purchaser has the meaning given in clause 2.1(b).

Family Share Offer means the Benefit described in clause 5.

Family means, in relation to a Family Referrer or Referred Family Purchaser as the case may be:

(a) a spouse or de facto partner;
(b) a parent (including the biological, adoptive, foster, custodial or non-custodial parent);
(c) a sibling (including the biological, adopted, foster or step sibling);
(d) a child (including the biological, adopted, foster or step child);
(e) a spouse or de facto partner of any of the people in (b) – (d) inclusive above;
(f) a company in respect of which any person in paragraphs (a) to (e) above is a shareholder or director or
(g) a trust or superfund in respect of which any person in paragraphs (a) to (e) above is a trustee or beneficiary.

Family Referrer means a Member who refers Family to Mirvac in accordance with clause 5.1 and 5.2.

 

Gold means the Gold Membership Tier as described in clause 3 and Gold Member has a corresponding meaning.

 

Land-Only Sale means the Eligible Contract is for the sale and purchase of a lot in a Participating Development on which the purchaser is required to construct a residential dwelling but excludes a Mirvac House and Land Package.

Lot Price means the GST inclusive purchase price specified in an Eligible Contract less the value of any upgrades, incentives or rebates provided under or in association with that contract.

Member means an approved member of the Dimensions Loyalty Program and Membership has a corresponding meaning.

Mirvac and we or us means Mirvac Projects Pty Limited ACN 001 069 245 and, where relevant, includes its relevant Related Bodies Corporate.

Mirvac House and Land Packages means the sale of a land-only lot in Participating Development on which the purchaser is required to construct a residential dwelling, where the purchaser simultaneously enters into a separate building contract with Mirvac Homes (NSW) Pty Ltd or Mirvac Home Builders (Vic) Pty Ltd (as applicable) for the construction of a dwelling on the lot.

MM Benefits has the meaning given in clause 7.1.

Participating Development has the meaning given in clause 2.2.

Personal Information has the meaning given in the Australian Privacy Act 1988 (Cth).

Purchaser Conditions means those conditions in an Eligible Contract that the purchaser must satisfy either before the contract becomes unconditional or before settlement can occur (eg, finance approval). Satisfaction of the Purchaser Conditions occurs when all such conditions have been satisfied or waived.

Priority Notification and Access means the Benefit described in clause 6.

Referred Family Purchaser has the meaning given in clause 5.2.

Related Body Corporate has the meaning given in the Corporations Act 2001 (Cth).

Related Entity has the meaning given in the Corporations Act 2001 (Cth).

Repeat Purchase Reward has the meaning given in clause 4.1.

Tiers means the level of membeship in the Dimensions Loyalty Program

VIP Partners means third party goods or services providers which Mirvac identifies to provide benefits.

VIP Partner Benefits means benefits offered by VIP Partners.
